Terms of Use

Dotser Limited is a company registered in the Republic of Ireland. These terms and conditions are provided by Dotser Limited (referred to as ‘us’, or, ‘we’ or ‘Dotser’) for the information of visitors (referred to as ‘you’ or ‘your’) to our website. This website is only for use by persons who have attained the age of 18 years and over.

The use of this site indicates your acceptance of these terms and conditions. The placement of an order indicates your acceptance of these terms and conditions. Please read them carefully and print a copy for future reference.

We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

We may change these terms and conditions at any time without prior notice to you. Any changes will take effect on the date they are posted on this website. You will be asked to read and accept the terms and conditions each time you place an order to ensure that you are familiar with the current terms and conditions prevailing at the time you place your order.

These terms and conditions do not affect your statutory rights.

Description of Goods
All the products we sell are of a technical nature and it is not practical to publish detailed specifications of all the products. All images, descriptive matter and specifications advertised on our site are for the sole purpose of giving an approximate description of the goods.

The intention of the Dotser is that all information on the website should be as accurate and up to date as possible. However, we cannot guarantee the reliability or the accuracy of the information contained within its pages. All the actions taken by the user of the website are the responsibility of the individual.

Payment and Price:
The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed. We are entitled to make adjustments to the price to take account of any increase in prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. We will inform you of the correct price and give you the opportunity to cancel the order or purchase a similar product.
All prices on our website are in euro and are exclusive of VAT and maybe subject to installation charges which are indicated at the time of placing an order.

Website: Use and Security:
You are entirely responsible for any and all activities that occur under your account which is provided by the Dotser Limited. You agree to notify us immediately of any unauthorised use or any breach of security.

We use Realex Payments to provide a secure and reliable payment processing service. Realex payments are approved and certified by many financial institutions. There are several technological layers in place to ensure the confidentiality and integrity of information. All information when in transit is encrypted (128 bits) to ensure the privacy of sensitive information. Realex payments have been accredited with Account Information Security certification by Visa. Realex payments are registered with the data protection Commissioner as a ‘data processor’. Cardholder information is encrypted and not displayed in our reporting systems.

Acceptance of Order:
Any email or other acknowledgement by us of receipt of an order placed by you does not constitute legal acceptance by us of your order.

Acceptance of your order and the formation of a contract take place when the goods you have ordered have been setup and activated, unless we have notified you that we do not accept your order or you have cancelled it in accordance with our cancellation policy.

We reserve the right not to supply goods and to cancel your order in the event of a pricing error or omission.

Typographical Errors:
In the event a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account to the value of the incorrect price (including delivery charges).

Payment Methods:
We accept most major credit and debit cards including Visa, MasterCard, American Express and Laser. When ordering you must provide us with your exact billing address and telephone number, matching the address and phone number your credit card bank has on file for you. Incorrect information will cause a delay in processing your order. Your order will only be processed once authorisation of your credit card has been properly received. You may also pay by cheque or postal order although we cannot dispatch the goods until payment has been cleared which can take at least 10 days.

Availability of Goods:
All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for these and we will refund any money already paid for them. However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods.

Delivery Charges:
All delivery charges will be added to the price of the products at our checkout.

Delivery Times:
We will endeavour to setup products within the Republic of Ireland within 5 working days from clearance of payment. Setup of products outside the Republic of Ireland will take approximately 10 working days. We will endeavour to setup products and services within the times stated. Any dates specified for the setup of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for setup of the goods. If for any reason of any delays we will notify you of this position. In respect of unforeseen prolonged delays you will have the right to cancel the order and we will refund any money paid by you for the goods. Alternatively, you can opt to purchase a similar product of equal value. At the time of installation/setup you will be required to validly sign for the product.
This does not affect your statutory rights.

Access to dotser.ie
We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

Errors and Omissions:
We make every effort to ensure that the information on our site is accurate and up to date. We will promptly correct any errors brought to our attention.

We reserve the right to withdraw any item from sale, at any point for whatever reason.

Content Submission
• All logos, text content, images and photography to be supplied by the client, together, in electronic format, before commencement of project.

• Logos should be in vector format (.eps).

• Photos should be submitted in high resolution format (.jpeg).

Additional Work outside Project Scope
• Any work or requests outside the scope of the agreed project outlined in this quotation (after sign off on content writing, graphic designs, etc.) will be charged at €45 per hour or at an agreed rate in advance.

• Upgrade Modules/Additional Features available at any stage of, or after development.

Intellectual Property:
• Custom graphics and website content become the property of the client on receipt of full payment.

• HTML copy of the entire website to be provided to client on termination of hosting agreement, if such course of action arises.

• All system code remains the exclusive property of DOTSER Ltd. & is provided with a lifetime, non transferable license and must reside on Dotser hosting platforms.

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of this website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.

You acknowledge and agree that the material and content contained within this website is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using this website. You further acknowledge that any other use of the material and content of this website is strictly prohibited and you agree not to assist or facilitate any third party to copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content. All brand names, logos and trademarks are property of the respective owners.

Miscellaneous Provisions:
We will issue you with an invoice once we have dispatched the goods to you. Failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions.

If you are using our products for business purposes please ensure that you are covered by the appropriate insurance. Where you decide to use the products in the course of a business, we exclude (to the fullest extent permitted by law) those warranties and conditions relating to fitness for a particular purpose. Our maximum liability to business users arising out of or in conjunction with the products shall be limited to the placement value of the product in question (except; in the case of death or personal injury caused by our negligence). In relation to business users, we do not accept liability for loss of use of the item or any loss over and above the cost of the item in the event of a claim for breach of warranty or condition.

You may not assign or sub-contract any of your rights or obligations under these terms and conditions or any related reservation for products to any third party unless agreed upon in writing with us.
If any part of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other parts of these terms and conditions shall not be affected.

These terms and conditions supersede all prior representations, understandings and agreements between you and the Dotser relating to the use of this website (including the order for products) and sets out the entire agreement and understanding between you and the Dotser for your use of this website.
